Former Barcelona and Brazil full-back Dani Alves has been denied bail again by the Spanish court as the investigation into his sexual assaults allegations continues.
The 40-year old was arrested in January over alleged sexual assaults of a woman in a Barcelona nightclub on December 30, 2022.
These accusations saw Mexican side Pumas UNAM terminated the 40-year old contract
Having been unsuccessful in their bail applications in February and May, Alves’ defence applied for another bail on Monday, but again the Barcelona court ruled that the former fullback remains in Jail.
This is after the court dismissed the video evidence put forward by the defense showing alleged flirting with the accuser. The court ruled flirting should not “in any way justify an eventual sexual assault.”
Alves will now remain in custody at Brians II prison in Spain and has now been reportedly declared a flight risk, despite the defence being willing to give up the his passports and agree to a tracking device.
The court has also dismissed claims that Alves and his family had plans to live in Barcelona, after it was found that his children were only registered as residents a few weeks ago.
Alves continues to deny any wrongdoing, claiming that the sex with the woman in question was consensual. A trial date has still not been set.
Under Spain’s sexual consent law passed last year, sexual assault takes in a wide array of crimes from online abuse and groping to rape, each with different possible punishments. A case of rape can receive a maximum sentence of 15 years.
